@PhilESkyline: The true answer is no. Nolan in an interview said that he was in post production on TDK when Heath died and so the thought never occured to use Joker in the 3rd as he was still working on the TDK. I really apologise for not having a source, it's very late here and I'm not sure what video it is (Might even be a podcast). But I assure you I heard this from Nolan himself.

(Pretty sure this is the interview,)

@kylekrane: As stated above, this is most likely a rumour/joke.

@PhilESkyline: Yeah, I guess I can see that happening.

It is a possibility. If you recall, the Joker was left hanging at the end of The Dark Knight and the scene was immediately cut to the Two-Face part. It is safe to assume that the Joker was taken into custody and would make a comeback in the next sequel. And who knows? Maybe Nolan had Harley Quinn in mind and would have her in the movie as well. That'd be great if we were to have the Joker, Harley and Catwoman (and possibly Bane too) in the same movie.

It would have been epic to start TDKR with Joker in Arkham Asylum laughing as he watch TV of them talking about Harvey Dent being a hero.

Am I the only one who reads interviews? Nolan didn't even think he was going to make a 3rd batman film when he was making The Dark Knight. Seriously, this shit is on the wikipedia page:

Nolan wanted the story for the third installment to keep him emotionally invested. "On a more superficial level, I have to ask the question," he reasoned, "how many good third movies in a franchise can people name?" Nolan claimed he never even thought a third film was possible in the foreward for his book The Art and Making of the Dark Knight Trilogy. Nolan only agreed to a third film on the basis of finding a worthwhile story, fearing that he would become bored halfway through production if he discovered the film to be unnecessary.

I believe that, looking at the trilogy especially the first and last films, Christopher Nolan intended for THe League of Shadows to return in some kind of revenge plan to actually topple Gotham. Perhaps Nolan wanted more films in between the first and last to begin with, but I feel that the consistency and continuity was really well done. Each of the films tie in nicely...in fact the only thing that hurts the continuity of the films is Maggie Gyllenhaal having to replace Katie Holmes. Other than that I really do think that the overview scope of the series was kept intact for the most part.

directors often say stuff like that; it doesn't mean anything. Sam Raimi said it after SPIDER-MAN 3, but then within a year was working on the (cancelled) SPIDER-MAN 4. Here is what Nolan said to Entertainment Weekly (this is a direct quote):

"From a fairly early stage in the process of making the three films we knew how Bruce's story would end."
